By downloading, installing, or using the Trax AI mobile application ("App" or "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

This App is licensed, not sold, to you. Your use of this App is subject to Apple's Licensed Application End User License Agreement (EULA) and these additional Terms. If there is any conflict between Apple's EULA and these Terms, Apple's EULA will control.

2. Description of Service

Trax AI is an AI-powered nutrition tracking mobile application that provides:

- AI-powered food photo analysis and nutritional estimation

- Daily calorie and macronutrient tracking (protein, carbs, fats)

- Personalized meal recommendations and nutrition plans

- Weight tracking and progress monitoring

- Workout tracking and calorie burn estimation

- Barcode scanning for packaged foods

- Goal setting and achievement tracking

- Data synchronization across devices (with account)

3. Eligibility and Account Requirements

- You must be at least 13 years old to use this Service

- Users between 13-17 must have parental consent

- You must provide accurate and complete information during registration

- You are responsible for maintaining the security of your account credentials

- You may sign in using Google or Apple authentication services

- One account per person; shared accounts are not permitted

4. Subscription and Payment Terms

4.1 Free and Premium Features

**Free Features:** Basic food logging, manual food entry, basic analytics, goal tracking, weight tracking

**Premium Features (Subscription Required):** Unlimited AI food scanning, AI meal recommendations, workout tracking, barcode scanning, text food recognition, cloud synchronization

4.2 Subscription Plans and Pricing

- Monthly Premium: $10.99 per month (auto-renewable)

- Yearly Premium: $30.99 per year (auto-renewable, save 75%)

- All payments processed through Apple App Store or Google Play Store

- Subscriptions automatically renew unless cancelled before renewal date

- Pricing may vary by region and may change with notice

4.3 Free Trial and Billing

- New users may receive a 3-day free trial for yearly subscriptions

- Trial automatically converts to paid subscription unless cancelled

- No charges during the trial period

- Cancel anytime through App Store or Google Play account settings

- Billing cycles begin immediately after trial ends

4.4 Cancellation and Refunds

- Cancel subscription anytime through your app store account settings

- Refunds are handled according to Apple App Store and Google Play Store policies

- Contact support@traxai.app for refund assistance

- Access to premium features continues until the end of current billing period

- No partial refunds for unused portions of subscription periods

5. External Services and Third-Party Integration

The App integrates with external services including but not limited to:

- OpenAI services for AI-powered food and workout recognition

- Firebase services for authentication and data storage

- OpenFoodFacts database for nutritional information

- Google and Apple authentication services

These external services have their own terms of service and privacy policies. You agree to use these external services at your own risk. We are not responsible for the content, accuracy, or availability of external services.

6. Intellectual Property Rights

- The App, including all content, features, and functionality, is owned by Trax AI

- You are granted a limited, non-exclusive, non-transferable license to use the App

- You may not copy, modify, distribute, sell, or lease any part of the App

- All trademarks, service marks, and logos are proprietary to their respective owners

- You retain ownership of photos and data you submit to the App

- By submitting content, you grant us a license to use it for providing the Service

7. Data Usage and Privacy

- Your use of the App is subject to our Privacy Policy

- We collect and process data as described in our Privacy Policy

- Photos uploaded for analysis may be processed by AI services

- You can delete your account and data at any time through app settings

- Data synchronization requires an account and internet connection

- We implement appropriate security measures to protect your data

8. Acceptable Use Policy

Permitted Use:

- Use the App for personal, non-commercial nutrition and fitness tracking

- Follow all applicable laws and regulations

- Respect the rights of other users and third parties

Prohibited Activities:

- Upload inappropriate, offensive, or harmful content

- Attempt to reverse engineer, hack, or circumvent the App's security

- Use the App for any illegal or unauthorized purposes

- Share false or misleading nutritional information

- Violate any intellectual property rights

- Abuse or overload our AI services or attempt to extract training data

- Use automated tools to access the App without permission

9. Health and Medical Disclaimers

Not Medical Advice:

- The App provides general nutritional information and estimates only

- AI analysis results are not intended as medical advice or treatment

- Always consult healthcare professionals for medical decisions

- Food recognition and calorie estimates may not be 100% accurate

- Nutritional information is for informational purposes only

Health Conditions and Safety:

- Users with medical conditions should consult doctors before use

- The App is not suitable for treating eating disorders or medical conditions

- Discontinue use if it negatively affects your mental or physical health

- Individual nutritional needs vary significantly by person

- Pregnant, nursing, or chronically ill individuals should seek professional guidance

- AI-generated meal plans are suggestions, not medical prescriptions

10. Warranties and Limitation of Liability

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW:

- We disclaim all warranties, express or implied

- We do not warrant that the App will be error-free or uninterrupted

- Our liability is limited to the amount you paid for the App

- We are not liable for indirect, incidental, or consequential damages

- AI analysis accuracy is not guaranteed

- Third-party service availability is not guaranteed

11. Export Control and Compliance

You may not use or export the App except as authorized by applicable laws. In particular, the App may not be exported or re-exported to any U.S.-embargoed countries or to anyone on the U.S. Treasury Department's Specially Designated Nationals List or the U.S. Department of Commerce Denied Persons List. By using the App, you represent that you are not located in such a country or on such a list.

12. Termination

- You may cancel your subscription anytime through your app store account

- You may delete your account through the app settings

- We may suspend or terminate accounts for violations of these Terms

- Termination does not affect existing payment obligations

- Upon termination, your license to use the App ends

- Data deletion follows the procedures outlined in our Privacy Policy

13. Governing Law and Jurisdiction

These Terms are governed by the laws of Queensland, Australia. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of Queensland, Australia. If you are using the App outside Australia, you consent to the application of Australian law and jurisdiction.

14. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated through the App or via email if you have an account. Your continued use of the App after changes constitutes acceptance of the updated Terms. If you do not agree to the changes, you should stop using the App.

15. Severability and Entire Agreement

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect. These Terms, together with our Privacy Policy and Apple's EULA, constitute the entire agreement between you and us regarding the App.

16. Apple App Store Specific Terms

The following terms apply specifically to the Apple App Store version of this App, as required by Apple's minimum terms:

Maintenance and Support

We, not Apple, are solely responsible for providing maintenance and support services for the App. Apple has no obligation to furnish any maintenance and support services.

Warranty and Refunds

We are solely responsible for any product warranties. In the event the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price. To the maximum extent permitted by law, Apple will have no other warranty obligation, and any other claims will be our sole responsibility.

Product Claims

We, not Apple, are responsible for addressing any claims relating to the App, including: (i) product liability claims; (ii) claims that the App fails to conform to legal requirements; and (iii) claims arising under consumer protection or privacy legislation.

Intellectual Property Claims

In the event of any third-party claim that the App infringes intellectual property rights, we, not Apple, will be solely responsible for investigation, defense, settlement, and discharge of such claims.

Third Party Beneficiary

You acknowledge that Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and Apple has the right to enforce these Terms against you as a third-party beneficiary.
